Business name

I see all sorts of way to search data bases to see if someone registered a business name but is that reliable? Is it b est to have an attorney for that or can one do it all on their own. What did you all do?

I searched on my own, then filed with the county as a DBA business name. They approved it, so I assume their search also showed that name to be available, and therefore mine.

Not that I'd depend on a governmental agency for much else.

It's possible for the name to not be used anywhere, and I think possible to find that out. You probably would have to pay an attorney to be absolutely certain, but unless you want to be a national chain someday (which is great if you do!), or expect to move around a bit and have no idea where (military folks, maybe), I'm one that wouldn't worry about it enough to pay an attorney. There may be an accessible national database, though. It would be fun to find! (But if you find it, don't show me. I'd sit here and read it instead of getting up to vacuum. )

I had an atty do ours, BUT, if I recall they only file it for the area you are in. Possibly the state, but I think it was just over a certain number of counties.

It was a long time ago, so I don't recall. Could be something to google though. "How much coverage filing a corporate name" ???????? Dunno, but maybe.

I have googled so much I dream google. : I got a call out to an attorney who I know and we have traded services. While this isn't his 'specialty' I am sure he will direct me in the right direction.

You would need to register with the US Patient and Trademark office. This would be considered a Trademark. You can search all current Trademarks on this site http://www.uspto.gov Once you get the trademark, then no one else can use that trademark for that class. If you want total control of the name you would need to register in every class. There are a lot of attorneys who specialize in the trademark law. It is always important to check with an expert. But it would be a nice place to start.
